By purchasing and using The Purrgola, the purchaser ("Customer") acknowledges and agrees to the following terms and conditions:
Assumption of Risk
The Customer understands and acknowledges that the use of The Purrgola, including but not limited to climbing, scratching, or interacting with the furniture, carries inherent risks, including the potential for injury to the Customer, their property, or their animal(s), even when the product is used as intended and according to instructions.
2. Release of Liability
The Customer hereby agrees to release, indemnify, and hold harmless CATTIO LLC, its owners, employees, agents, and affiliates (collectively, "Company") from any and all liability, claims, demands, damages, or causes of action, whether known or unknown, arising out of or related to the use of the The Purrgola,, including any injury, damage, or loss to the Customer, their property, or their animal(s) that may occur, regardless of whether such injury, damage, or loss occurs due to misuse or proper use of the product.
3. No Liability for Injury
The Customer agrees that the Company is not liable for any physical injury, illness, emotional distress, or any property damage incurred by the Customer, their animal(s), or any third parties while using the product, even if the product is used in accordance with provided guidelines, instructions, and warnings.
4. Agreement to Hold Harmless
The Customer agrees to hold the Company harmless for any claims, losses, liabilities, or expenses, including but not limited to legal fees, arising from any injury or damage related to the use of the The Purrgola, whether or not such injury or damage is caused by negligence, improper use, or any other factor.
5. Acknowledgment of Understanding
By purchasing and using the The Purrgola, the Customer confirms that they have read and fully understand this Liability Waiver and Hold Harmless Agreement and agree to its terms.
